A certificate for
IMC layout designs shall be valid within 10 years from the date of filing an application
for registration with the Patent Office, or from the first commercial
exploitation, provided that an application shall be filed with the Patent
Office within 2 years from the first commercial exploitation.
An
IMC layout design meets the
requirements of patentability if it is original.
An application shall be made
out in Ukrainian language and shall contain the following:

request for registration of an IMC layout design
|

•
|
documents identifying an IMC layout design.
|
The examination procedure
consists of formal and substantive examination.
A certificate is granted within 1 month after an IMC
layout design has been registered in the State Register.
A notice of opposition to the registration of an
IMC layout design may be given to the Board of Appeals
within 6 months from the date of publication of the mentioning of the certificate
granting.

In case of non-use of an IMC layout design before the date of filing an
application, a full set of documents depicting every layer the IMC layout design
(masks, drawing of arranged integrated circuits, or drawings of each layer of
an IMC layout design, photographs of each layer of an IMC layout design embodied in the
integrated circuit)

|
•
|
In case of use of an IMC layout design prior to the date of filing an
application, specimens of an integrated circuit which is an embodiment of an
IMC layout design as it was exploited for the commercial purposes (four pieces)
|
